Bakgrund
Leo Pharma AB (Leo) marknadsför läkemedlet Adtralza, (tralokinumab) injektionslösning. Adtralza är avsett för behandling av måttlig till svår atopisk dermatit hos vuxna och ungdomar i åldern 12 år och äldre som behöver systemisk behandling.
IGN har 2025-04-24 från Almirall Aps (Almirall) mottagit en anmälan rörande marknadsföringen av detta läkemedel. Till anmälan bifogades upphörandeuppmaning (bilaga 3) och svar på upphörandeuppmaning (bilaga 4).

Anmälan avseende vilseledande läkemedelsinformation från Leo Pharma Nordic vid läkemedelsinformation på svensk sjukhusklinik
1. Bakgrund
Almirall ApS anmäler härmed läkemedelsinformation som framförts av Leo Pharma Nordic vid en läkemedelsinformation på en svensk sjukhusklinik. Vid detta tillfälle presenterade en representant från Leo Pharma en kostnadsjämförelse mellan Dupixent, Adtralza och Ebglyss som, enligt Almiralls bedömning, är vilseledande. Jämförelsen visades i form av stapeldiagram avseende dels ”Kostnad startår, vecka 0–52”, dels ”Kostnad underhållsår, vecka 53–104” (bilaga 1 och 2).
Almirall ApS skickade den 24 mars 2026 en upphörandeuppmaning till Leo Pharma Nordic AB (bilaga 3), där vi redogjorde för de metodologiska bristerna i framställningen och varför den enligt vår uppfattning är vilseledande. I sitt svar den 27 mars 2026 (bilaga 4) har Leo Pharma Nordic bestridit att materialet strider mot Läkemedelsbranschens etiska regelverk (LER). Ärendet underställs därför härmed IGN:s prövning.
2. Den anmälda åtgärden
Den aktuella framställningen består av jämförande stapeldiagram där namngivna läkemedel ställs sida vid sida med angivna belopp i SEK under rubrikerna ”Kostnad startår, vecka 0–52” respektive ”Kostnad underhållsår, vecka 53–104”. Presentationen ger därmed intryck av att visa jämförbara behandlingskostnader för de aktuella produkterna.
Det är ostridigt att de belopp som använts i jämförelsen utgår från offentliga AUP/listpriser och doseringsregimer enligt respektive produktresumé. Det är dock samtidigt ostridigt att nationella återbärings- och paybackavtal gäller för samtliga relevanta produkter och att nettopriser därför inte är offentliga. Leo Pharma har själva uppgett att materialet inte är avsett att spegla faktiska nettopriser, tenderutfall eller den faktiska kostnaden för enskilda regioner.
Mot denna bakgrund är det enligt Almiralls uppfattning missvisande att rubricera framställningen som ”kostnad” och att presentera den i ett exakt jämförande stapeldiagram. När namngivna produkter ställs upp sida vid sida i ett sådant diagram kommuniceras oundvikligen en relativ fördel och en kostnadsbaserad rangordning mellan behandlingarna, även i avsaknad av ett uttryckligt överlägsenhetspåstående.
Valet av stapeldiagram är därför inte neutralt. Tvärtom förstärker formatet ett implicit jämförande och promotivt budskap: att mottagaren bör uppfatta vissa behandlingar som mer kostnadsfördelaktiga än andra. Det gäller särskilt när framställningen använder exakta kronorbelopp, eftersom detta ger intryck av precision och verklig jämförbarhet i en situation där den faktiska kostnadsbilden inte kan verifieras på grund av konfidentiella återbäringsavtal.
Prisuppgifter hämtade från fass.se kan i denna situation inte anses relevanta för att beskriva verklig behandlingskostnad. Samtliga aktuella biologiska behandlingar inom atopisk dermatit omfattas av konfidentiella återbäringsavtal med regionerna, vilket innebär att de faktiska behandlingskostnaderna inte kan utläsas av offentliga listpriser. En jämförelse som framställs som ”kostnad” men i realiteten bygger på icke-representativa listpriser riskerar därför att vilseleda mottagaren.
Det förhållandet att Leo Pharma i efterhand beskriver jämförelsen som enbart illustrativ förändrar inte den omedelbara och naturliga innebörd som framställningen förmedlar till mottagaren vid presentationstillfället.
Den sammantagna effekten är att hälso- och sjukvårdspersonal lätt kan få uppfattningen att Adtralza är det mest kostnadsfördelaktiga alternativet, trots att detta saknar grund i verifierbara data om faktisk nettokostnad. Detta gäller särskilt eftersom innebörden av återbäringsavtal och deras påverkan på verkliga behandlingskostnader inte nödvändigtvis är väl känd bland alla mottagare av läkemedelsinformation.
3. Grund för anmälan
Den anmälda åtgärden står enligt Almiralls uppfattning i strid med LER kapitel 1, avdelning 1, artiklarna 1 och 4.
Enligt artikel 1 ska läkemedelsinformation vara saklig, rättvisande, objektiv, meningsfull och balanserad. En framställning som rubriceras som ”kostnad”, men som bygger på listpriser som inte speglar de verkliga behandlingskostnaderna, kan inte anses uppfylla dessa krav. Därtill förstärker det valda presentationsformatet – jämförande stapeldiagram med exakta kronorbelopp – ett budskap om precision och jämförbarhet som underlaget inte medger.
Enligt artikel 4 får läkemedelsinformation inte vara vilseledande genom överdrift, utelämnande eller oklart framställningssätt. I detta fall är det inte endast fråga om att den bakomliggande jämförelsegrunden är ofullständig; själva framställningsformen förstärker också en slutsats som materialet inte kan bära. Även om de enskilda listpriserna i sig skulle vara korrekta, skapar presentationen som helhet en missvisande bild av relativa behandlingskostnader och leder mottagaren mot en kostnadsbaserad rangordning som inte kan verifieras.
Det är därför Almiralls uppfattning att den anmälda framställningen är ägnad att vilseleda i strid med både artikel 1 och artikel 4 LER.
4. Yrkande
Almirall hemställer att IGN prövar den anmälda framställningen och finner att Leo Pharma Nordic genom den aktuella läkemedelsinformationen har agerat i strid med LER.
Almirall begär vidare att Leo Pharma Nordic åläggs att upphöra med användning av listprisbaserade kostnadsjämförelser för biologiska läkemedel inom atopisk dermatit när sådana framställs som uttryck för relativa behandlingskostnader trots att faktiska nettopriser inte är offentliga eller verifierbara.
Almirall begär även att Leo Pharma Nordic säkerställer att framtida kostnadskommunikation inte, vare sig uttryckligen eller underförstått, ger intryck av att visa verkliga eller jämförbara behandlingskostnader när sådana inte kan fastställas på grund av konfidentiella återbäringsmodeller.
Svaromål
I sitt svaromål skriver Leo:
We refer to Almirall’s report concerning our material of Adtralza, specifically some slides containing a comparison between medicinal products based on official list prices published on FASS.se.
Upon receiving the cease and desist notice from Almirall on 24 March 2026, Leo Pharma carefully reviewed the material in question and responded substantively on 27 March 2026. We note that Almirall has elected to escalate the matter to IGN. Leo Pharma reaffirms its commitment to compliance with LIF's ethical code and welcomes the opportunity to address the Board on the substance of the complaint.
We note that Almirall have stated their grounds for reporting as contravention of Chapter 1, article 1 and 4 of LER and we respectfully submit the following compliance-based clarification demonstrating that the material is fully compliant with the Swedish ethical framework (Läkemedelsbranschens etiska regelverk, LER), assessed under Chapter 1, Articles 1, 4, 10, 12 and 17. We structure our response around four grounds of defense.
- Context of the assessed material
The complaint appears to be based solely on partial images of two individual slides extracted from a PowerPoint presentation of 4 slides. Leo Pharma respectfully submits that assessing compliance on the basis of partial images of isolated slides, without consideration of the full slide deck and its overall narrative, risks leading to an incomplete and potentially misleading evaluation. Notably, Almirall have omitted from their complaint the front page describing the basis and premises of the comparison, as well as the tables beside the bar charts, where it is stated that the comparison is on the basis of AUP prices. According to Article 4 of the LER, pharmaceutical information must not be misleading directly or indirectly. Our understanding of this includes that material must be assessed based on its overall impression, including how information is framed and balanced across the entirety of the communication.
Furthermore, the presentation was delivered orally by a company representative, with explanatory commentary provided alongside the slides. This oral component forms an integral part of how the information was conveyed and understood by the audience.).
Key contextual factors:
- The slides do not contain explicit claims or conclusions regarding price superiority or overall economic advantage. They pre-sent factual information intended to support a broader clinical discussion.
- The presentation was not accompanied by any hand-outs or leave-behind materials. No copies of the slides were distributed to participants.
- The material was shown only in a live presentation setting and not used as standalone promotional documentation.
The significance of this point cannot be overstated: because no materials were distributed, the slides cannot be re-read, forwarded, or considered out of context by recipients. The information existed solely within the live, orally contextualized presentation environment. Any assessment of "misleading impression" must therefore account for the totality of what the audience received, including the presenter's verbal qualifications, and not treat the slides as if they were standalone print advertisements subject to repeated review out of context.
Leo remains fully transparent and cooperative with IGN and, have attached the complete slide deck for contextual review. However, given the commercial sensitivity of the material, we kindly request that the slides be treated as confidential and limited strictly to the purposes of the present assessment.

- The material includes prominent and proximate contextual information
The material clearly states that the prices used in the comparison are the official list prices and that national discounting agreements apply to all products. This information appears with significance prominence on the first slide and the information on list price is repeated on the subsequent slides, not in a separate footnote, appendix etc. The caveat is therefore proximate and contemporaneous with the comparative information. This on-slide qualification serves a dual function: it satisfies mandatory disclosure requirements and simultaneously ensures that the audience is explicitly reminded that the comparison operates at the listprice level only. The material does not claim, expressly or by implication, that the list-price comparison represents net acquisition costs, regional purchasing costs, or overall cost-effectiveness in clinical practice.
- The recipient standard: Specialist HCPs would not be misled by clearly labelled list-price information
The assessment of whether material is "misleading" under Article 4 LER must be conducted from the perspective of the intended recipient, not from the perspective of a hypothetical, unusually uninformed recipient. In this case, the audience here consisted specialist dermatologists at hospital clinics and private clinics, presented to in a live, interactive setting with oral qualification.
Almirall itself acknowledges in its correspondence that experienced prescribers and 'insiders' understand the distinction between list prices and net costs. The recipients of this presentation were precisely such specialists. Almirall's own framing therefore confirms that the actual audience possessed the professional expertise to interpret the charts correctly. Assessed from this perspective, there is no realistic basis on which a specialist physician would interpret an AUP-labelled bar chart accompanied by an explicit caveat that national rebate agreements apply, as a statement about actual net acquisition costs
- Use of official list prices is mandatory information and “Kostnad” is standard terminology for AUP calculations
- List prices are mandatory and the only verifiable reference
According to Chapter 1, Article 17 LER, written promotional material directed to healthcare professionals must include mandatory information, including price information for reimbursed medicinal products or a clear reference to where such information can be found, typically FASS.se. Official list prices therefore represent the only transparent, publicly available, and verifiable price reference that can be used in compliant promotional material. Confidential net prices and regional rebate agreements are not public and cannot be discussed in promotional interactions, as this would undermine the principles of verifiability set out in Article 10 LER. Consequently, the use of list prices from FASS.se is not only permissible but necessary to ensure compliance with LER.

- Almirall's position would render Article 17 unworkable
Almirall's complaint, taken to its logical conclusion, would effectively prohibit any comparative price information for products covered by confidential rebate agreements. Since virtually all hospital-dispensed biologics in the Swedish atopic dermatitis market are subject to such agreements, the consequence would be that Article 17 becomes unworkable across the entire therapeutic area. Almirall does not propose any alternative methodology that would simultaneously satisfy Article 17 (include price information) and the standard they advocate (never compare list prices). Leo Pharma submits that Article 17, read together with Article 10, expressly contemplates and requires reference to publicly available price data, which is precisely what the material provides.

- The term "kostnad" is standard official Swedish HTA terminology for AUP-based calculations
Almirall alleges that Leo Pharma's use of the heading "Kostnad" (cost) on the bar charts implies actual net treatment cost and is therefore misleading. Leo Pharma submits that this allegation is directly contradicted by established Swedish regulatory and HTA practice. TLV, Sweden's own pharmaceutical pricing and reimbursement authority, consistently uses the term "kostnad" (cost) to describe AUP-based treatment cost calculations. In its decision of 28 January 2022 concerning Adtralza itself, TLV states and similar wordings is used in the assessment of Almirall’s own product Ebglyss:
"För den aktuella patientgruppen är kostnaden för användning av Adtralza lägre än kostnaden för användning av Dupixent. Resultaten är beräknade utifrån fastställt AUP för både Adtralza och Dupixent."

This is not an isolated example. The following additional sources demonstrate that "kostnad" is the accepted standard term for AUP-based calculations across Swedish pharmaceutical decision-making:

Leo Pharma's use of the heading "Kostnad" to describe AUP-based calculations is therefore not only linguistically accurate but follows established official Swedish HTA practice used by TLV, NT-rådet, and regional pharmaceutical councils. To hold that this terminology is misleading would require IGN to find that TLV's own published decisions, including TLV's decision on this very product in this very therapeutic area, use misleading language. Leo Pharma respectfully submits that this proposition is untenable.
Furthermore, the regional pharmaceutical council for Sydöstra sjukvårdsregionen (Jönköping, Kalmar, Östergötland) presents AUP-based figures in a comparative table format under the heading "Kostnad per patient per år" when comparing biologics in atopic dermatitis i.e., the identical format and terminology that Leo Pharma used in the material at issue. This confirms that Leo Pharma's presentation mirrors the standard format used by the very decision-makers in question.
- Price comparisons are done objective and transparently
Article 12 LER permits comparative claims provided they are fair, objective, and not misleading. In the medicinal context, price comparisons must therefore be based on treatment cost, which necessarily includes approved dosing, treatment duration, and clinical use. In the present case, Leo Pharma has transparently presented both a base-case (cost with every 2 weeks dosing) and a best-case dosing scenario (cost with dosing every 4 weeks) for its own product, while comparing this against a best-case dosing scenario for the comparator products (showing the every 4 week dosing and not showing the higher cost of dosing every 2 weeks with comparator).
Leo Pharma wishes to emphasize the significance of this methodological choice: had Leo intended to maximize the apparent cost difference, as Almirall's complaint implies, Leo Pharma would have shown competitors at their highest-cost dosing regimen (q2w) while showing Adtralza only at its most favorable dosing (q4w). Leo Pharma did the opposite. It presented its own product in both scenarios (including the less favorable q2w) and competitors in their best-case scenario only. This affirmative methodological conservatism is inconsistent with any intent to mislead and demonstrates precisely the fairness and balance that Article 12 requires.
Given the clear statement that discounting agreements apply, there is no doubt that the charts' purpose is to show relative pricing differences at the official list-price level for the respective dosing regimens, and that there has been no omission, exaggeration, or unclear presentation.
Conclusion
For the reasons set out above, Leo Pharma submits that the material in its entirety at issue is compliant with LER. Specifically:
Article 1 (Saklighet): The information is accurate (based on verified FASS prices), objective (using transparent dosing methodology that favours competitors), meaningful (list prices are relevant to clinical decision-making as confirmed by TLV's own practice), and balanced (multiple scenarios presented, limitations clearly stated).
Article 4 (Vederhäftighet): The material does not mislead — whether assessed by reference to the sophisticated specialist audience, the explicit on-slide caveats, the use of standard official HTA terminology, the absence of any superiority claim, or the full oral presentation context. Almirall provides no evidence of actual misleading effect.
Articles 10, 12, 17: The material satisfies mandatory information requirements using the only verifiable price data available; comparisons are fair, balanced, and based on clinically relevant dosing; and confidential information is appropriately not disclosed.
Leo Pharma respectfully requests that the Board dismiss Almirall's complaint in its entirety.
Almirall kommentar till svaromål
Vi vidhåller vår ståndpunkt att Leo Pharmas presentation är vilseledande i strid med artikel 4 i LER (kapitel 1, avdelning 1).
Sedan Leo började använda prisjämförelser i sina presentationer möts våra representanter regelbundet av invändningar från dermatologer som uppfattar att Adtralza är billigare än alla andra jämförbara alternativ. När vi frågar efter källan hänvisar dermatologerna konsekvent till den aktuella jämförelsen från Leo. Att budskapet har fått detta genomslag bland förskrivare bekräftar att det vilseledande intrycket faktiskt påverkar kliniska beslut — vilket är precis den skada som artikel 4 i LER avser att förhindra.
Även i avsaknad av ett uttryckligt överlägsenhetspåstående innebär presentation av namngivna produkter sida vid sida i ett jämförande stapeldiagram oundvikligen att en relativ fördel kommuniceras och att publiken styrs mot en kostnadsbaserad rangordning av behandlingar. Användningen av stapeldiagram antyder i sig precision och jämförbarhet. Inom ett område där nettobehandlingskostnader inte är verifierbara förstärker detta format en slutsats som datan inte medger, även om listpriserna i sig är faktuellt korrekta.
Bedömningen bör göras utifrån det helhetsintryck som materialet ger en normalt uppmärksam mottagare — inte utifrån om Leo tekniskt sett har inkluderat en disclaimer någonstans i materialet. Att inkludera en generell hänvisning till att återbäringsavtal existerar neutraliserar inte det vilseledande helhetsintrycket av ett jämförande stapeldiagram som tydligt rangordnar produkter efter kostnad. Presentationen leder förskrivare att vid en snabb anblick få intrycket att jämförelsen av kostnader utifrån AUP-priser är korrekt och relevant, när en korrekt och relevant jämförelse omöjligt kan göras av ett enskilt företag eftersom kostnad efter återbäring inte är publik.
Leo har inte insyn i konkurrenternas återbäringsavtal och kan därför inte själva veta om den rangordning som deras presentation antyder är korrekt. Att presentera en jämförelse man inte kan verifiera som faktabaserad är i sig vilseledande. Om ambitionen från Leo vore att upplysa om kostnader borde företaget istället hänvisa mottagarna till den aktuella regionen som är den enda part, utöver TLV, som har full insyn i de olika alternativens kostnader efter återbäring.
Det saknas inte alternativa och bättre informationskällor om kostnader och kostnadsjämförelser — förskrivare kan exempelvis vända sig till verksamhetschefen, läkemedelskommittén eller regionens fullmaktshavare. Mot bakgrund av detta finns inget mervärde för klinikerna att ta del av Leos jämförelse baserad på AUP-priser. Risken är däremot uppenbar att mottagare av informationen nöjer sig med Leos version och inte efterfrågar relevant information från regionen — särskilt med tanke på de tids- och kunskapsbarriärer som finns inom regionerna för att ta del av kostnad efter återbäring.
Hälso- och sjukvårdssystemet, inklusive LIF och IGN, bör enligt vår mening hålla industrin till en högre standard. Vi anser att Leos presentation strider mot kravet på vederhäftighet i artikel 4 i LER och uppmanar IGN att ålägga Leo Pharma att upphöra med denna typ av prisjämförelser.
Slutkommentar från Leo
Leo Pharma has reviewed Almirall's comments and notes that they largely reiterate the original complaint. We limit ourselves to three brief observations on points that require correction.
1. Almirall's claims about what dermatologists have said cannot be verified — and are irrelevant to the assessment
Almirall refers to anecdotal reports from their field team about what dermatologists have allegedly said. Leo Pharma has no means of verifying these claims, we do not know who said what, in what context, or whether any such statement was in fact linked to our material rather than to other sources such as TLV's own published decisions or regional cost data. Unverifiable second-hand assertions from a competitor's sales representatives cannot constitute a basis for IGN's assessment.
2. Almirall mischaracterizes the contextual information Leo provided
Almirall states that the assessment should focus on the overall impression and "inte utifrån om Leo tekniskt sett har inkluderat en disclaimer någonstans i materialet.". Leo Pharma agrees that the overall impression is the correct standard and that is precisely why Almirall's characterization is misleading.
The contextual information in Leo's material is not a buried footnote or a disclaimer “somewhere." The introduction slide of the presentation - the first thing the audience see - clearly and legibly establishes that the comparison is based on AUP (list prices) and that confidential rebate agreements exist for all products. This information is repeated on subsequent slides adjacent to the charts themselves. Moreover, this was an oral presentation, the presenter actively walked the audience through these premises before showing the comparison. The audience did not need to independently "read" and "find" a disclaimer, the basis was presented to them verbally and visually as the opening framing of the entire presentation.
When Almirall reduces this to a disclaimer technically included “somewhere in the material," they are asking the Board to disregard the actual context and structure of the presentation. Leo Pharma submits that the overall impression, which is the correct standard, must include the oral delivery, the introduction slide, and the repeated on-slide qualifications, not just the bar charts in isolation.
3. A bar chart showing multiple scenarios is not a "ranking"
Almirall characterizes the bar charts as a format that "clearly ranks products by cost". This misrepresents the material. The charts present multiple dosing scenarios in which Adtralza is not the lowest-cost option in all cases, precisely because Leo Pharma included both q2w and q4w dosing for its own product. A presentation that shows its own product as more expensive in one of the displayed scenarios is self-evidently not a "ranking" designed to position that product as cheapest. It is a balanced, multi-scenario illustration consistent with the objectivity and fairness required by Article 12.
Conclusion
Almirall's comments do not present any new legal or factual basis that would alter the analysis in our initial response. Leo Pharma maintains its position and respectfully requests that the Board dismiss the complaint.
IGNs bedömning och beslut
Anmälan rör en presentation där behandlingskostnaden vid atopisk dermatit för Leos läkemedel Adtralza jämförs med kostnaden för två konkurrerande läkemedel. Kostnaden för läkemedlen redovisas som stapeldiagram för behandling varannan vecka för Dupixent samt varannan vecka och var fjärde vecka för Adtralza och för Ebglyss. Totalkostnaderna per år för startår respektive underhållsår beräknas utifrån AUP och antal doser för varje läkemedel.
Almirall hävdar att denna kostnadsjämförelse är vilseledande då det för samtliga ingående läkemedel föreligger hemliga rabattavtal som gör att kostnadsjämförelser baserade på listpris inte är relevanta. Mot denna bakgrund är det enligt Almiralls uppfattning missvisande att rubricera framställningen som ”kostnad” och att presentera den i ett exakt jämförande stapeldiagram. När namngivna produkter ställs upp sida vid sida i ett sådant diagram kommuniceras oundvikligen, enligt Almirall, en relativ fördel och en kostnadsbaserad rangordning mellan behandlingarna, även i avsaknad av ett uttryckligt överlägsenhetspåstående.
Leo hävdar att man i presentationen varit transparent med att det utöver listpris/AUP även föreligger nationella rabattavtal för samtliga produkter. Vidare hävdar man bland annat att mottagarna av informationen, specialister inom dermatologi, är väl skickade att förstå informationen och dess betydelse samt att ”kostnad” utgör standardterminologi för AUP-beräkningar, bland annat i TLVs utlåtanden.
Det talar enligt IGN till Leos fördel att man på presentationens första sida tydligt redovisat att det utöver listpris föreligger nationella rabattavtal. Dock anser IGN att Leo bör ha haft ett syfte med att presentera kostnadsberäkningar baserade på listpris och doseringsregim och att detta syfte torde vara kommersiellt. Bilderna med stapeldiagrammen har rubriken Kostnad startår, vecka 0-52 respektive Kostnad underhållsår, vecka 53-104. Kostnaden uttrycks även på motstående sidor i tabellform. På dessa sidor, där det grafiskt framstår tydligt som om Adtralza har lägst kostnad både med dosering var annan vecka och var fjärde vecka startåret och med dosering var fjärde vecka underhållsåret, saknas upplysningen om nationella rabattavtal. Dessa bilders utformning stöder att syftet varit att framställa behandling med Adtralza som en mindre kostsamt behandling jämfört med de övriga läkemedlen, trots att den verkliga kostnaden efter rabatt inte är känd.
Med hänvisning till ovan sagda finner IGN att Leos marknadsföring strider mot artiklarna 1 och 4 LER (kapitel 1, avdelning 1). Avsteget bedöms vara en överträdelse av normalgraden och därför bestäms avgiften till 110 000 kr. Fakturering sker från LIF Service AB.
